Rule 41
Completion
: (1) If an application for compensation is received in accordance with sub-section (1) or (2) of section 36 of the Act, the relevant body or official shall form a committee including experts in the relevant subject within fifteen days of receiving the application to investigate the application. .
(2) Notwithstanding anything written in sub-rule (1), a committee as per the sub-section shall be formed to investigate the petitions regarding the damage caused by pollution caused by the bodies or institutions as per sub-sections (4) and (5) of section 36 of the Act.
(3) The committee according to sub-rules (1) and (2) shall examine and examine the facts of the place concerned and submit a report with its opinion within thirty days to the relevant body or authority in relation to the application received.
(4) In the report according to sub-rule (3), the committee shall also disclose the amount of compensation to be paid after ascertaining the type, magnitude, impact and effect of the damage to the victim.
(5) According to sub-rule (4), when ascertaining the impact and effect of the damage, it shall be done on the basis of the immediate damage to human health or the environment or the damage that may occur in the long term or the extent of such damage.
(6) On the basis of the report received according to sub-rule (3), the relevant agency or officer shall make a decision on the matter of compensation within sixty days and inform the applicant and the person, organization or proposer who is to pay the compensation.
